What Are Compulsory & Independent Medical Exams?
When someone is seeking financial compensation for an injury—for example, in a personal injury lawsuit, a disability case, or a workers’ compensation case—they may be required to attend a CME or an IME. CMEs are ordered by defense counsel to determine whether injuries were sustained in an accident, and IMEs are ordered by plaintiff’s counsel to determine the extent of injuries sustained in an accident.
During one of these exams, an unbiased third-party doctor will examine the plaintiff and afterwards determine:
- If the plaintiff is actually injured
- How serious the plaintiff’s injuries are
- Whether the plaintiff’s complaints are related to the accident
What to Expect During a Compulsory or Independent Medical Exam
The CME/IME process will vary from one case to another depending on the type of injury involved. With that said, during a CME or an IME, the doctor will likely:
- Review the plaintiff’s medical records and imaging results
- Speak with the plaintiff about their personal and family medical histories
- Ask the plaintiff about their injury and the symptoms they’ve been experiencing
- Perform a physical examination
